TERMS & CONDITIONS
1. Making a contract with us.
When you place an order with us, you are making an offer to buy goods. Once we have checked the price and availability of the goods, we will e-mail you to confirm that we have received and accepted your order, and that a contract has been made between us.The PayPal payment method we use requires you to pay for the goods and services at the same time as placing the order - otherwise no order can be fulfilled.
In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order, and there will be no contract between us.
If, for any reason, the goods are not available, we will contact you and offer you to choose an alternative item. If this is not acceptable, we will re-imburse you to the value of that item. (See also 'Stock Levels' below).
2. Stock levels
We take great care to update our quoted stock levels regularly, but we also sell from the same stock in our Torquay shop. It is possible therefore, that occasionally, the stock levels quoted on the website do not reflect the actual numbers available. If you place an order for an item that is quoted as being in stock but we cannot fulfill your order, we will mutually agree with you to (a) offer you a full no-quibble refund, (b) offer you a suitable alternative, or (c) reserve the item for you on our next order from our suppliers. (The latter option may mean wait times of between 3 to 6 weeks).
3. How to place an order.
First choose your item from the relevant shop section and select the required quantity/size and/or pricing option from the drop down menu. To order this item select the button 'Add to cart'. To choose more items, continue to view the shop as desired, adding to cart as necessary.
Once you have made your final selection(s), please select 'View cart' which will then take you to the integrated and secure PayPal website. To complete your order, please select 'Proceed to checkout' and follow all further instructions. Failure to strictly follow these instructions may result in the loss of your order.
Lunazzurra uses an integrated PayPal system that makes it easy and secure for both parties. Please note that Lunazzurra has no direct control over the content and/or form of the Paypal integrated website and this content may change if Paypal choose to do so.
Postage & packing costs are quoted clearly at checkout. All deliveries will be made by Royal Mail Standard (3 day) postage service within the UK unless otherwise stated or advised.Recorded and special deliveries can be arranged at extra cost if required - prices on request. Rates to all other non-UK destinations will be advised on request by e-mail. We will endeavour to despatch your order within 7 to 10 working days from receipt of your order instruction. We will e-mail you if we encounter any problems in meeting this target. If the goods are lost or damaged in transit, please let us know promptly.
5a. Cancellation and Returns - non personalised items.
You can cancel your contract at any time up to 14 working days after the date of delivery, To do this, please e-mail us or write to us.
You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future. If you cancel you must return the goods at your own expense. You must ensure that the goods are packaged adequately to protect against damage. If you fail to return the goods we may arrange to collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.
5b.Cancellation and Returns - personalised items.5
If you need to cancel your order, please contact us immediately as we are unable to cancel an order once production has started.
We regret that we cannot offer returns on unwanted items that have been personalised. This is in line with Long Distance Selling Regulations governing the sale of personalised products.
This Cancellation and Returns Policy does not affect your legal rights - for example if goods are faulty or misdescribed.
6. Faulty Goods
If there is a problem with the goods, please contact us. We will deal with the matter in accordance with your legal rights. Photographic evidence of faulty or damaged items may be asked for before we can process a refund. Failure to provide photographic evidence may delay your refund.
7. Application of laws
The governance of English Law applies to these Terms and Conditions and forms part of these Terms and Conditions in accepting an order or contract between us.
8. Changes to these terms
These terms were last reviewed on 29th May 2020. These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.
If you do nothing other than read pages or download information while using this web site, we will not capture, record or store personal information about your visit.
If you place an order or make an enquiry we will keep your information on record solely for administration purposes and as a means to improving our site and services. We will not keep your details any longer than is necessary or for that length of time that we are legally obliged to do so.
With your prior consent, we may occasionally contact you by e-mail with news and marketing issues that may be of interest or benefit to you. If you wish to unsubscribe from this option please let us know and we will immediately remove your e-mail address from our mailing lists.
IMPORTANT: We will not, and never intend to knowingly, rent, sell or pass on any of your details to any third party unless obliged to do so by law. We value and respect your right to confidentiality within these bounds.
All collected data is in accordance with the Data Protection Act and the EU GDPR regulations (see The Information Commissioner's Office website for further information). Under these Regulations, whilst we are not required to be registered with the ICO, you are entitled to access information that we keep and you have the right to demand that this information is amended and/or deleted subject to our legal obligations.
